Sun Home Saunas Official Giveaway Terms & Conditions
1. Sponsor
This Giveaway ("Giveaway") is sponsored exclusively by Fish & Fischer LLC, a California limited liability company doing business as Sun Home Saunas, located in San Diego, California ("Sponsor," "we," "us," or "our"). This Giveaway is in no way sponsored, endorsed, administered by, or associated with Instagram (Meta Platforms, Inc.), its parent, subsidiaries, or affiliates, nor any other third-party platform, service, or entity. Entrants expressly release Instagram and all other third-party platforms from any and all liability arising from or related to this Giveaway. By entering the Giveaway, each entrant unconditionally acknowledges that they are providing their personal information solely to Fish & Fischer LLC d/b/a Sun Home Saunas, and not to Instagram or any other platform.
2. Eligibility
Strict eligibility requirements apply and will be enforced without exception.
The Giveaway is open only to natural persons who are (a) legal residents of the fifty (50) United States or the District of Columbia, (b) physically located within the United States at the time of entry, and (c) at least eighteen (18) years of age or the age of majority in their state of residence, whichever is older, at the time of entry. Corporations, partnerships, trusts, associations, and other non-natural persons are categorically ineligible.
The following individuals are expressly prohibited from participating:
- Employees, contractors, officers, directors, managers, members, and agents of Fish & Fischer LLC and any of its parent companies, subsidiaries, affiliates, successors, or assigns;
- Employees and agents of any advertising, promotion, fulfillment, prize supplier, or other agency involved in the development, administration, or execution of this Giveaway;
- Immediate family members (defined as spouse, domestic partner, parent, stepparent, sibling, stepsibling, child, or stepchild, regardless of where they reside) and household members (whether or not related by blood or marriage) of any of the above individuals.
The Giveaway is void where prohibited, taxed, or restricted by law. It is the sole responsibility of the entrant to determine whether participation is lawful in their jurisdiction. Sponsor assumes no responsibility for entries submitted from jurisdictions where the Giveaway is prohibited.
3. Giveaway Period
The Giveaway commences on the date and time the official Giveaway post is published on the @sunhomesaunas Instagram account ("Start Date") and concludes at 11:59:59 PM Pacific Time on the fifth (5th) calendar day following the Start Date ("End Date," and collectively the "Giveaway Period"). Entries received before the Start Date or after the End Date are void and will not be considered under any circumstances. The internal clock of Sponsor's systems shall be the official timekeeping device for this Giveaway and shall be determinative in the event of any dispute as to the timing of an entry. Sponsor reserves the right, in its sole and absolute discretion, to modify the Giveaway Period at any time with notice posted on the original Instagram post or landing page, and such modification shall be binding on all entrants.
4. How to Enter
NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS GIVEAWAY. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. VOID WHERE PROHIBITED.
There are two (2) authorized methods of entry. All other methods of entry are void:
a) Instagram Entry: Follow all instructions set forth in the official Giveaway post published by @sunhomesaunas on Instagram during the Giveaway Period. Entry actions will be specified in each individual Giveaway post and may include, without limitation, following @sunhomesaunas, liking the post, and/or tagging other users in the comments.
b) Email Landing Page Entry: Navigate to the designated Giveaway landing page on sunhomesaunas.com and submit a valid, functional email address via the entry form during the Giveaway Period.
Entry Limit & Anti-Fraud Policy: Each individual is strictly limited to one (1) total entry, regardless of the method(s) of entry used. Entries are tied to unique individuals, not merely unique email addresses. Any attempt by any individual to submit more than one (1) entry — whether through multiple email addresses, multiple Instagram accounts, the use of aliases, fictitious identities, or any other mechanism — will result in the immediate and permanent disqualification of every entry associated with that individual, without notice.
Entries generated, submitted, or assisted by any script, bot, macro, automated software, artificial intelligence tool, proxy, VPN intended to misrepresent location, or any other unauthorized mechanism are void in their entirety. Sponsor reserves the right to verify the eligibility of any entrant and to conduct fraud screening on all entries. Entrants who Sponsor, in its sole discretion, suspects of fraudulent activity will be disqualified and may be reported to appropriate authorities. Sponsor's determination regarding any entry dispute is final and binding.
5. Prize
Prize Description: One (1) grand prize winner will receive one (1) Sun Home Saunas infrared sauna (the "Prize"). The specific model will be identified in the applicable Giveaway Instagram post. The approximate retail value ("ARV") of the Prize will be stated in the Giveaway post. The ARV is based on the suggested retail price at the time the Giveaway is announced and is subject to change. Sponsor makes no representation or warranty as to the Prize's actual market value at the time of delivery.
Prize Conditions: The Prize is awarded "as is," with no warranty, express or implied, except for Fish & Fischer LLC's standard limited manufacturer's warranty applicable to the specific model awarded, which warranty is incorporated herein by reference. Standard delivery within the contiguous United States is included. Sponsor is not responsible for shipping to Alaska, Hawaii, U.S. territories, or any address outside the United States; any such accommodation, if offered, is solely at Sponsor's discretion.
The Prize is non-transferable, non-assignable, and may not be substituted, exchanged, or redeemed for cash or any cash equivalent by the winner under any circumstances. Sponsor expressly reserves the right to substitute the Prize, in whole or in part, with a prize of equal or greater value at any time and for any reason, including but not limited to unavailability of the stated Prize. No difference in value between the stated ARV and the actual value of the Prize, if any, will be awarded.
Tax Liability: Winner is solely and exclusively responsible for all federal, state, and local taxes, duties, and other charges imposed on the Prize, including but not limited to income taxes and any applicable use taxes. Winner may be required to provide a valid Social Security number or Individual Taxpayer Identification Number for tax reporting purposes prior to Prize delivery. Sponsor will issue an IRS Form 1099-MISC or other applicable tax form if and to the extent required by law. If winner refuses or is unable to provide required tax documentation, Sponsor reserves the right to forfeit the Prize and select an alternate winner.
6. Winner Selection & Notification
On or within seven (7) business days following the End Date, one (1) potential winner will be selected at random from among all eligible, non-disqualified entries received during the Giveaway Period by Sponsor or its designated representative. The selection will be made using a process Sponsor deems sufficiently randomized in its sole discretion. Odds of winning are determined solely by the total number of eligible entries received and are not affected by method of entry.
Official Notification: The potential winner will be contacted exclusively by Fish & Fischer LLC d/b/a Sun Home Saunas, via the email address provided at entry or via Instagram Direct Message from the verified @sunhomesaunas Instagram account only. Sun Home Saunas will never, under any circumstances, request payment of any kind, wire transfers, gift card purchases, banking or financial account information, Social Security numbers, or other sensitive personal or financial information as a condition of claiming, receiving, or processing a prize. Any communication purporting to be from Sun Home Saunas that requests such information is fraudulent and not authorized by Sponsor. Entrants who receive such communications should not respond and should report them to the appropriate platform or authorities.
Response Requirement: The potential winner must respond to the official prize notification within seventy-two (72) hours of the timestamp of Sponsor's notification. Failure to respond within seventy-two (72) hours, failure to provide complete and accurate contact and eligibility information, failure to return any required documentation within the specified period, failure to satisfy any eligibility requirement, or any other act or omission that prevents Sponsor from completing prize fulfillment will result in automatic forfeiture of the Prize without further obligation to the potential winner. In the event of forfeiture, Sponsor may, in its sole discretion, select an alternate winner from remaining eligible entries. Sponsor is not responsible for any failure to receive or respond to a notification due to entrant's spam filters, email settings, account inactivity, Instagram privacy settings, or any other technical or personal reason.
7. Winner Verification & Required Documentation
As a condition of receiving the Prize, the potential winner will be required to complete, sign, and return within seven (7) calendar days of being notified:
a) Affidavit of Eligibility confirming the winner meets all eligibility requirements set forth in these Terms & Conditions;
b) Liability Release releasing Fish & Fischer LLC, its members, officers, employees, agents, successors, and assigns from any and all claims arising out of or related to the Giveaway or Prize;
c) Publicity Release (where permitted by applicable law) granting Sponsor the right to use winner's name, likeness, photograph, voice, biographical information, and general location for advertising and promotional purposes without additional compensation; and
d) Valid government-issued photo identification and such additional documentation as Sponsor may require to verify eligibility, identity, age, and residency.
Non-delivery of signed documents within the specified period, submission of incomplete or fraudulent documentation, or failure to satisfy any verification requirement will constitute automatic forfeiture of the Prize. Sponsor's determination as to whether documentation satisfies its verification requirements is final and binding. Fish & Fischer LLC reserves the right to conduct background or identity verification checks on any potential winner.
8. Consent to Marketing Communications
By submitting an entry to this Giveaway — whether via Instagram or the email landing page — each entrant expressly and affirmatively consents to receive recurring commercial electronic mail communications from Fish & Fischer LLC d/b/a Sun Home Saunas, including but not limited to promotional offers, new product announcements, sales events, and other marketing content. This consent is provided in accordance with the CAN-SPAM Act and, where applicable, other applicable state and federal laws. Entrants may withdraw consent and unsubscribe from marketing communications at any time by clicking the "unsubscribe" link contained in any marketing email or by contacting Sponsor at the address in Section 16. Unsubscribing will not affect any pending Giveaway entry or the selection process.
9. Privacy
All personal information collected in connection with this Giveaway will be collected, processed, stored, and used in accordance with Fish & Fischer LLC's Privacy Policy, located at sunhomesaunas.com/policies/privacy-policy, and applicable federal and state privacy laws. By entering, each entrant acknowledges and agrees that their personal information may be used to administer the Giveaway, select and notify the winner, fulfill the Prize, comply with legal obligations, and, with consent as described in Section 8, send marketing communications. Fish & Fischer LLC will not sell, rent, or otherwise disclose entrant personal information to unaffiliated third parties for their own independent marketing or advertising purposes without the entrant's prior, separate consent.
10. Intellectual Property & License Grant
By entering this Giveaway, each entrant irrevocably grants Fish & Fischer LLC d/b/a Sun Home Saunas a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, non-exclusive, sublicensable, and transferable license to reproduce, display, perform, distribute, modify, adapt, create derivative works from, and otherwise use any content submitted or created in connection with entry into this Giveaway (including but not limited to Instagram comments, tags, captions, images, and story shares) ("Entrant Content") for any purpose, including but not limited to commercial advertising, product promotion, social media, and public relations, in any media now known or hereafter devised, without further compensation, notice, or attribution to the entrant.
Each entrant represents and warrants that: (a) they are the sole author and owner of all rights in the Entrant Content, or have obtained all necessary rights and permissions from applicable third parties; (b) the Entrant Content does not and will not infringe, misappropriate, or otherwise violate any intellectual property right, right of publicity or privacy, or any other right of any third party; (c) the Entrant Content does not contain any false, defamatory, obscene, offensive, or illegal content; and (d) the Entrant Content does not violate any applicable law. Entrant agrees to indemnify, defend, and hold harmless Fish & Fischer LLC and the Released Parties (as defined in Section 11) from and against any third-party claims arising from a breach of these representations and warranties.
11. Indemnification & Limitation of Liability
By entering this Giveaway, each entrant agrees, to the fullest extent permitted by applicable law, to indemnify, defend, and hold harmless Fish & Fischer LLC d/b/a Sun Home Saunas, Instagram (Meta Platforms, Inc.), and each of their respective parent companies, subsidiaries, affiliates, members, officers, directors, employees, agents, contractors, representatives, successors, assigns, advertising agencies, promotion agencies, prize suppliers, and fulfillment providers (collectively, "Released Parties") from and against any and all claims, demands, actions, causes of action, suits, proceedings, losses, damages, liabilities, costs, penalties, fines, and expenses (including reasonable attorneys' fees and court costs) arising out of or in any way related to:
a) Entrant's participation in, or inability to participate in, the Giveaway; b) Entrant's breach of these Terms & Conditions or any applicable law or regulation; c) The acceptance, possession, receipt, use, or misuse of the Prize, including but not limited to any personal injury, death, property damage, or other harm; d) Any claim that Entrant Content infringes upon the rights of any third party; e) Any technical failure, malfunction, error, omission, interruption, deletion, defect, delay, or failure related to the Giveaway platform, entry process, or Prize delivery; f) Unauthorized human or machine intervention in any part of the Giveaway; or g) Any printing, typographical, administrative, or technological errors in any Giveaway materials.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FISH & FISCHER LLC OR ANY RELEASED PARTY BE LIABLE TO ANY ENTRANT OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR PERSONAL INJURY, ARISING FROM OR RELATED TO THIS GIVEAWAY, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER OR NOT FISH & FISCHER LLC WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Fish & Fischer LLC's total aggregate liability to any entrant, if any, shall not exceed fifty dollars ($50.00). Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages; in such jurisdictions, the foregoing limitations shall apply to the fullest extent permitted by law.
12. Disqualification & Right to Cancel
Sponsor reserves the right, in its sole and absolute discretion, without notice and without liability to any entrant or any other party, to:
a) Disqualify any entrant who Sponsor determines has violated these Terms & Conditions, engaged in fraudulent activity, tampered with the entry process, or acted in an unsportsmanlike or disruptive manner;
b) Cancel, suspend, modify, or terminate the Giveaway, in whole or in part, at any time and for any reason, including but not limited to technical failures, security breaches, fraud, forces beyond Sponsor's reasonable control (including but not limited to acts of God, pandemic, war, or government action), or any other cause that, in Sponsor's judgment, corrupts or threatens the integrity or proper operation of the Giveaway;
c) Select a winner from all eligible entries received prior to any cancellation or modification, or cancel the Giveaway in its entirety without awarding a prize; and
d) Pursue all available legal remedies against any individual determined to have engaged in fraudulent activity, unauthorized tampering, or any other conduct intended to undermine the integrity of the Giveaway.
13. Disputes, Governing Law & Mandatory Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
These Terms & Conditions and all aspects of this Giveaway shall be governed by and construed in accordance with the laws of the State of California, without regard to any conflict-of-law rules or principles that would cause the application of the laws of any other jurisdiction.
Binding Arbitration: Except as set forth below, any and all disputes, controversies, or claims arising out of or relating to this Giveaway, the Prize, or these Terms & Conditions — including any question regarding the existence, validity, interpretation, or enforceability of these Terms & Conditions — shall be resolved exclusively by final and binding arbitration administered by JAMS pursuant to its Streamlined Arbitration Rules & Procedures in effect at the time of the dispute. The arbitration shall be conducted by a single neutral arbitrator and shall take place in San Diego, California. The arbitrator's award shall be final and binding, and judgment may be entered upon it in any court of competent jurisdiction. The arbitrator shall have no authority to award punitive or exemplary damages.
Class Action Waiver: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EACH ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO BRING OR PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING OF ANY KIND AGAINST FISH & FISCHER LLC OR THE RELEASED PARTIES IN ANY FORUM, AND ANY SUCH CLAIMS MAY ONLY BE BROUGHT IN AN INDIVIDUAL CAPACITY. This waiver shall be enforceable even if the applicable arbitration rules would otherwise permit class proceedings.
Small Claims Exception: Notwithstanding the foregoing, either party may bring an individual claim in small claims court in San Diego County, California, provided the claim qualifies and remains in such court.
Jury Trial Waiver: EACH ENTRANT IRREVOCABLY WAIVES ANY AND ALL RIGHTS TO A TRIAL BY JURY IN ANY DISPUTE ARISING OUT OF OR RELATED TO THIS GIVEAWAY.
Injunctive Relief: Notwithstanding any other provision herein, Fish & Fischer LLC reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of its intellectual property, trade secrets, or other proprietary rights, without the requirement to post bond.
14. Winners List & Official Rules
For the name of the winner (available after the conclusion of the Giveaway), send a written request with a self-addressed, stamped envelope postmarked within thirty (30) days of the End Date to: Fish & Fischer LLC d/b/a Sun Home Saunas — Giveaway Winner Request, San Diego, CA [INSERT ZIP]. Please specify the name of the applicable Giveaway in your request. Residents of Vermont may omit return postage.

15. General Provisions
These Terms & Conditions constitute the entire agreement between each entrant and Fish & Fischer LLC with respect to the Giveaway and supersede all prior or contemporaneous communications, representations, or agreements, whether written or oral. If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect. The failure of Fish & Fischer LLC to enforce any right or provision of these Terms & Conditions shall not constitute a waiver of such right or provision. Fish & Fischer LLC's decisions and interpretations regarding all matters relating to the Giveaway, including but not limited to eligibility, entry validity, winner selection, prize fulfillment, and dispute resolution, are final, conclusive, and binding on all entrants in all respects.
Any attempted or actual violation of these Terms & Conditions or any attempt to defraud, manipulate, or undermine the Giveaway in any way may result in disqualification, criminal prosecution, civil litigation, and any other available legal remedy at Fish & Fischer LLC's sole discretion.
