Fish & Fischer, LLC doing business as Sun Home Saunas (“Sun Home,” “we,” “our,” or “us”) respects the privacy of your information. This Privacy Policy is designed to assist you in understanding how we collect, use, and safeguard the information we collect about you in connection with providing our services (the “Services”), including our website or mobile app (collectively the “Site”).

From time to time, we may change this Privacy Policy. If we do, we will post an amended version on this webpage. If we make material changes to our Privacy Policy, we may also notify you by other means, such as sending an email or posting a notice on our home page. If required by applicable data protection laws, we will obtain your consent to any material changes. Please review this Privacy Policy periodically.

Through your use of the Services, we collect personal information about you. The categories of personal information about you we collect include the following.

Information You Provide

When you use the Services, you may voluntarily provide us with your personal information, such as the following: 

  • Purchase a Product Online.  When you purchase a product on the Site with us, you will provide us with your first and last name, country/region, street address, town/city, state, zip code, phone number, email address, and payment information.
  • Live Chat.  When you use a live chat to speak with a customer representative, you will provide us with your first and last name, email address, and the content of your communication.
  • Apply for Financing.  We use Affirm to approve and issue a line of credit to our customers and offer financing for purchases in the United States. When you apply for financing through Affirm, you may provide with your name and email address, as well as other personal information as requested by Affirm, subject to Affirm’s privacy policy available here. If we assist you in completing the application over the phone, we will maintain a recording of the conversation.
  • Request Product Support.  When you contact us for product support by webform, you will provide us with your first and last name, sauna model, description of the issue, phone number, and email address, and you may also provide a photograph of the sauna issue. When you contact us by telephone, you may need to provide us with your first and last name, email address, phone number, and sauna model.
  • Contact Us. When you contact us by telephone or email, you may need to provide us with your first and last name, email address, and/or phone number.
  • Schedule a Call.  When you schedule a call with us, you will provide us with your first and last name, email address, and phone number.
  • Join Our Partner Program.  To join our partner program, you must provide us with your first and last name, company name, email address, phone number, email list size, social media follower size, promotional methods, how you would like to work with us, and whether you own a Sun Home sauna.
  • Join Our Referral Program.  To join our referral program, you must provide us with your first and last name, company name, email address, and phone number.
  • Interact with our Services.  When you send us any feedback, questions, comments, suggestions, ideas, or interact with us in any way, you may need to provide us with your first and last name, and email address. Our Services may also allow you to communicate with us through SMS (short message service), email, and other communication channels.

Information We Automatically Collect

We automatically collect certain personal information through your use of the Services. such as the following:

  • Usage Information. We collect information such as which of the pages on the Site you access, the frequency of access, and what you click on while on the Site.
  • Device Information. We collect information about the device you are using, such as hardware model, operating system, application version number, and browser.
  • Mobile Device Information. In addition to the “device information” listed above, when you access our Site via a browser on your mobile device, we collect information about whether you are accessing the Site via a mobile device or tablet, device type, and carrier.
  • Location Information. We collect location information from Site visitors on a city-regional basis.

Third Party Information

In some cases, we may receive certain personal information about you from a third party. For example, when someone purchases a Sun Home product on your behalf, that individual may provide your name and physical address for the delivery. We may also collect your personal information from our service providers and business partners, such as analytics or advertising and marketing providers.

If you submit any personal information about another individual to us, you are responsible for making sure that you have the authority to do so and to allow us to use their personal information in accordance with this Privacy Policy.

How We Use Your Personal Information

We use each category of the personal information described above to provide the Services to you, to improve our Services, and to protect our legal rights. In addition, we may use the personal information we collect to:

  • Provide information to you about product pricing and instant sale pricing;
  • Provide you with a Sun Home product;
  • Provide information to you about joining our partner program;
  • Contact you regarding our products and services that we feel may be of interest to you;
  • Communicate with you about our Services or to inform you of any changes to our Services;
  • Provide support;
  • Maintain, analyze, and improve our Services;
  • Defend our legal rights and the rights of others, including establishing, asserting, exercising, defending against, or enforcing legal claims, legal rights, legal obligations, legal processes, government requests, and our policies;

How We Share Your Personal Information

  • With service providers who perform data services on our behalf (e.g., email, hosting, maintenance, backup, analysis, marketing and advertising, etc.)
  • To the extent that we are required to do so by law;

  • To any person who we reasonably believe may apply to a court or other competent authority for disclosure of that personal information where, in our reasonable opinion, such court or authority would be reasonably likely to order disclosure of that personal information;
  • To any other person or entity as part of any business or asset sale; and
  • To any other person or entity where you consent to or direct the disclosure or the disclosure is otherwise permitted by applicable law.

Sun Home does not share the SMS opt-in consent to any 3rd party organization.

How We Retain Your Personal Information

We retain personal information for the length of time necessary to carry out the purposes described in the Privacy Policy. We also retain information for related business purposes, security, legal compliance, and disputes and claims handling, consistent with our retention policy and as permitted by applicable law.

Like many other companies, we use cookies and other tracking technologies (such as pixels and web beacons) to enhance your online experience, to analyze and improve our Services, and for other purposes described in the “Collecting and Using Information” section above. Please note, we and our service providers may monitor visits to our Services and sessions of users; this monitoring may log or record the details of your visits to our Services and information generated in the course of using our Services, such as clicks, page visits, text entered, how long you spent on a page, and other details of your visits to or actions on our Services. We use these technologies to collect, retain, and share with service providers usage data for the purposes described in the “Collecting and Using Information” section above.

Some internet browsers incorporate a “Do Not Track” feature that signals to websites you visit that you do not want to have your online activity tracked. Given that there is not a uniform way that browsers communicate the “Do Not Track” signal, the Site does not currently interpret, respond to, or alter its practices when it receives “Do Not Track” signals.

Depending on your location (and reflecting applicable law), you may have been asked to indicate your preferences about advertising or marketing information, provide us with your consent regarding the receipt of such information from us, and indicate how you would like to receive it.

Please note that your opt-out is limited to the phone number used..

As is common practice among businesses that operate online services, we have disclosed certain personal information to our business partners such as social media and advertising partners to serve personalized content or advertising tailored to your interest. Under applicable law, these disclosures may be considered as a “sale” of personal information for consideration, “sharing” of personal information for “cross-context behavioral advertising,” or processing of personal information for “targeted advertising.” [We process opt-out preference signals from Global Privacy Control (“GPC”), which is a browser-level technical specification that you can use to inform websites that you wish to opt out of the sale or sharing of personal information or processing of personal information for targeted advertising. The Services may contain links that will let you leave the Services and access another website. Linked websites are not under our control. This Privacy Policy applies solely to personal information that is acquired through the Services. We accept no responsibility or liability for these other websites.

We maintain commercially reasonable security measures designed to protect the personal information we collect and store from loss, misuse, destruction, or unauthorized access. However, no security measure or modality of data transmission over the internet is 100% secure. Although we strive to use commercially acceptable means to protect your personal information, we cannot guarantee absolute security.

The Services are not intended for children under 18 years of age. We do not knowingly collect, use, or disclose personal information from children under 18.

Depending on the jurisdiction in which you are located, you may have additional rights with respect to your personal information. We discuss some of those jurisdictions and rights below. For example, you may have the rights to access, delete, update, or correct your information. You also may have the right to object to or opt out of direct marketing from us. Notice to Nevada Residents

Nevada law allows Nevada residents to opt out of the sale of certain types of personal information. Subject to a number of exceptions, Nevada law defines “sale” to mean the exchange of certain types of personal information for monetary consideration to a person for the person to license or sell the information to additional persons. We do not currently sell personal information as defined in the Nevada law. However, if you are a Nevada resident, you still may submit a verified request to opt-out of sales and we will record your instructions and incorporate them in the future if our policy changes. Collection of Personal Information

We currently collect and, in the 12 months prior to the Effective Date of this Privacy Policy, have collected, the following categories of personal information about California residents directly from them, through automated means, and from our service providers, business partners, and other third parties (e.g., data analytics providers and social networks):

  • Identifiers (such as name-; postal address-; internet protocol address-; email address-; account name-; device identifier; cookies, pixel tags, and mobile advertising identifier; and other similar identifiers).
  • Personal information described in California Civil Code § 1798.80(e) (such as “identifiers” described in the preceding bullet; credit and debit card number; and telephone number).
  • Internet or other electronic network activity information (such as browsing history; search history; and information regarding your interaction with the Services).
  • Geolocation data
  • Commercial information (such as records of products or services purchased, obtained, or considered; and other purchasing or consuming histories or tendencies).

  • Inferences drawn from other personal information described in this Privacy Policy.
  • Sensitive personal information (such as your account log-in, financial account, debit card, or credit card number in combination of required security or access code, password, or credentials).

In addition to the purposes stated above in the section “Collecting and Using Information” we currently collect and have collected the above categories of personal Information for the following business purposes:

  • Auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards.
  • Helping to ensure security and integrity to the extent the use of your personal information is reasonably necessary and proportionate for these purposes.
  • Debugging to identify and repair errors that impair existing intended functionality.
  • Short-term, transient use, provided that the personal information is not disclosed to another third party and is not used to build a profile about you or otherwise alter your experience outside the current interaction, including, but not limited to, the contextual customization of ads shown as part of the same interaction.
  • Performing services on behalf of us, including providing customer service, processing or fulfilling orders and transactions, verifying customer information, or providing similar services on behalf of us.

  • Undertaking internal research for technological development and demonstration.

We do not use sensitive personal information to infer characteristics about consumers.

Sale and Sharing of Personal Information 

As is common practice among businesses that operate online services, in the 12 months preceding the Effective Date of this Privacy Policy, we have disclosed certain identifiers, internet or other electronic network activity information, and inferences to our business partners such as social media and advertising partners to serve personalized content or advertising tailored to your interest. Under the CCPA, these disclosures may be considered as a “sale” of personal information for consideration or “sharing” of personal information for “cross-context behavioral advertising.” But we do not disclose, and have not disclosed in the 12 months preceding the Effective Date of this Privacy Policy, personal information of individuals we know to be under 16 years of age for consideration or cross-context behavioral advertising.

Our Process for Verifying a Privacy Rights Request

As required or permitted by the CCPA, we will verify your identity before processing your privacy rights request. We may require you to provide your first name, last name, email address, the amount of your last transaction, and the date of your last transaction to verify your identity.

Right to Non-Discrimination

We will not discriminate against California residents if they exercise any of the rights provided in the CCPA as described in this section “Notice to California Residents.” As such, we will not deny goods or services to that California resident; charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; provide a different level or quality of goods or services to the California resident; or suggest that the California resident will receive a different price or rate for goods or services or a different level or quality of goods or services. However, we are permitted to charge a California resident a different price or rate, or provide a different level or quality of goods or services, if that difference is reasonably related to the value provided to us by the individual’s personal information.

Shine the Light Law

We do not disclose personal information obtained through our Site or Services to third-parties for their direct marketing purposes. Accordingly, we have no obligations under California Civil Code § 1798.83.

Notice to Residents of Certain Additional States

If you are a resident of a state in which a state-level comprehensive privacy law that applies to Sun Home is enacted other than California, this “Notice to Residents of Certain Additional States” section may apply. If you are not a resident of one of the states with a state-level comprehensive privacy law, this does not apply to you and you should not rely on it.

Profiling

We do not process your personal information for the purpose of profiling in furtherance of decisions that produce legal or similarly significant effects under applicable law.
